Acceptance of Terms of Use
These Terms of Use govern your use of the Malayalam IPTV service and
website. By using, visiting, or browsing the Malayalam IPTV service or
website, you accept and agree to be bound by these Terms of Use. If you do
not agree to these Terms of Use, you should not use the Malayalam IPTV
service or website. These Terms of Use are an ongoing contract between you
and Malayalam IPTV and apply to your use of the Malayalam IPTV service and
website. These Terms of Use affect your rights and you should read them
carefully.
Changes to Terms of Use
Malayalam IPTV, reserves the right, from time to time, with or without
notice to you, to change these Terms of Use in our sole and absolute
discretion. The most current version of these Terms of Use can be reviewed
by clicking on the "Terms of Use" located at the bottom of the pages of the
Malayalam IPTV website. The most current version of the Terms of Use will
supersede all previous versions. You can see changes from previous versions
of the Terms of Use by clicking here if any.
Privacy
Any personally identifying information submitted through the Malayalam IPTV
service or on the Malayalam IPTV website is subject to our Privacy Policy,
the terms of which are incorporated herein. Please review our Privacy Policy
to understand our practices. The date of any changes to our Privacy Policy
will be noted at the bottom of our Privacy Policy.
How Our Service Works
Malayalam IPTV is an online IPTV subscription service providing its members
with access to television and comprehensive library of motion pictures from
Indian sub-continent, and other audio-visual entertainment
("Serials/Sop-Opera/Live-Shows etc") content on standard definition streamed
over the public Internet. We offer a variety of membership plans at varying
price levels, including special promotional plans or memberships with
limitations on the number of TV-channels/movies during a month. Under Movies
List, members select movies at our website, they will show-up on Set-Top-Box
menu for live streaming and user may also instantly watch certain movies on
your personal computer or, on certain membership plans, through a Malayalam IPTV ready device.
We reserve the right in our sole and absolute discretion to make changes
from time to time and without notice in how we operate our service. Any
description of how our service works should not be considered a
representation or obligation with respect to how the service will always
work. We are constantly making adjustments to our service and often these
adjustments are not completely captured within these Terms of Use.
- TV/VOD Stream Delivery Speed
We utilize a nationwide network of local broad-band providers to send and
receive Video you have selected to rent through the subscription. Based on
performance data from the broadband provider and our own analysis, we have
determined that the large majority of our members are able to receive their
Video at 1Mb/Sec bit rate are higher to view un-buffered video.
- Plans and Contract Restrictions:
Affordable Plan has the following restrictions: Since our STB is rented to
you for a period of 6 months to recover the cost of device $59.99
(subsidized price) we have devised this plan to make it more affordable for
Malayalam IPTV customers. We expect our customers to honor the commitment
for 6 months in-order for us to recover the cost of the device supplied for
your viewing of Malayalam IPTV content. The customer shall become the owner
of the STB after 6 months payment. Customer can put on hold the service for
a maximum period of three months by paying $4.99 per month.
WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP
PERIODS OR UNWATCHED Content. To cancel, login into account under MalayalamIPTV.net, choose “Your Account” page and follow the instructions
for cancellation under the heading "Cancel Membership." Taxes charged will
not be refunded.
Bandwidth requirement: We stream all the channels and videos at 1.5 mb bit
rate depending on still vs action oriented sequences in the video stream.
Hence for uninterrupted service 1.5 mb internet bandwidth with unlimited
downloads is required.

located at the top of the pages of the Malayalam IPTV Web site.
Billing
By starting your Malayalam IPTV membership, you are expressly agreeing that
we are authorized to charge you a monthly membership fee, any applicable tax
and any other charges you may incur in connection with your use of the
Malayalam IPTV service to the Payment Method you provided during
registration (or to a different Payment Method if you change your account
information). Additional charges may include gift subscription purchases you
make, movies you rent from your STB on-demand request. As used in these
Terms of Use, "billing" shall indicate either a charge or debit, as
applicable, against your Payment Method, including a checking account, where
applicable. The membership fee will be billed at the beginning of your
membership and on each monthly renewal thereafter unless and until you
cancel your membership. Click on the "Membership Terms and Details" link on
the "Your Account" page to see the commencement date for your next renewal
period. We automatically bill your Payment Method each month on the calendar
day corresponding to the commencement of your membership. In the event your
membership began on a day not contained in a given month, we bill your
Payment Method on the last day of such month. For example, if you became a
paying member on January 31st, your Payment Method would next be billed on
February 28th. You acknowledge that the amount billed each month may vary
from month to month for reasons that include differing amounts due to
promotional offers, differing amounts due to changes in your membership
plan, changes in the amount of applicable sales tax, and charges for VOD.
All fees and charges are nonrefundable and there are no refunds or credits
for partially used periods. At any time, and for any reason, we may provide
a refund, discount, bonus disc or other consideration to some or all of our
members ("credits"). The amount and form of such credits, and the decision
to provide them, are at our sole and absolute discretion. The provision of
credits in one instance does not entitle you to credits in the future for
similar instances, nor does it obligate us to provide credits in the future,
under any circumstance. We may change the fees and charges in effect, or add
new fees and charges from time to time, but we will give you advance notice
of these changes by email. If you want to use a different Payment Method or
if there is a change in your credit card validity or expiration date, you
may edit your Payment Method information by clicking on the "Your Account"
button, available at the top of the pages of the Malayalam IPTV Web site. If
your Payment Method reaches its expiration date and you do not edit your
Payment Method information or cancel your account (see, "Cancellation"
below), you authorize us to continue billing that Payment Method and you
remain responsible for any uncollected amounts.
Ongoing Membership
Your Malayalam IPTV membership will continue in effect unless and until you
cancel your membership or we terminate it. You must cancel your membership
before it renews each month in order to avoid billing of the next month's
membership fees to your Payment Method. We will bill the monthly membership
fee plus any applicable tax to the Payment Method you provide to us during
registration (or to a different Payment Method if you change your account
information).
Cancellation
You may cancel your membership to Malayalam IPTV at anytime with the
agreement that if you can cancel within the first 6 months the set top box
charge of $59.99 will be charged to the cc on file , and cancellation will
be effective immediately. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY
PARTIAL-MONTH MEMBERSHIP PERIODS OR UNWATCHED MOVIES/TV Content. To cancel,
click the words "Cancel Membership" on the "Your Account" page and follow
the instructions for cancellation under the heading "Cancel Membership."
There is no refund on the STB (Set Top Box) and it is the property of the
subscriber, all STB sales are final. The original cost of the STB is $99.99,
the same is offered to customers at subsidized prices on different plan
basis.
We reserve the right to terminate your account for any or no reason.
LIMITED ONE YEAR WARRANTY
The Set Top Box, remote and the power supply shall be construed as
If within one (1) year from the date of purchase, if the product fails due
to a defect in material or workmanship, we shall repair if possible or
replace it free of charge. This warranty applies only to the original
purchaser and the device cannot be transferred to a third party.
We shall not be liable for incidental or consequential damages to the
purchaser or any other party for any loss, damage, injury, or expense of any
kind or nature caused directly or indirectly by the product or the failure
of the product to operate properly.
This warranty is in Liew of all other express or implied warranties,
including the warranty of merchantability and the warranty of fitness for a
particular purpose, are hereby modified to exist only as contained in this
limited warranty and shall be of the same duration as the warranty of

The warranty does not apply to: (a) damage caused by accident, abuse, in
handling, dropping; (b) acts of God; (c) units which have been subject to

not used in accordance with directions; (e) damages exceeding the cost of
the product; (f) depreciated or loss of charge time; (g) the finish on any
portion of the product, such as surface scratches and/or weathering, as this
is considered normal wear and tear. Some states do not allow a limitation of
damages so the foregoing limitation may not apply to you. This warranty
gives you specific legal rights and you may also have other rights, which
vary from state to state.
Warranty service is available by mailing postage prepaid to the authorized
service facility provided. Warranty does not cover the cost of postage to
send the product in for service. Purchaser is responsible for safely sending
the product to repair facility. Please be sure to wrap the product securely
when mailing to avoid shipping damage.
Features & Functionality
- Watch VOD Movies Instantly
Malayalam IPTV allows you to instantly watch available movies on your
personal computer or, on certain membership plans, on a television or
similar display through a Malayalam IPTV ready device. Currently, the
instant watching functionality is provided to you at no additional charge;
however, under certain of our membership plans, the instant watching
functionality may not be available for viewing content on Malayalam IPTV
ready devices. The movies you watch instantly will be in addition to movies
you receive under your existing membership. Instant watching movies may not
contain all the same features you will find on a DVD-version of the same
movie, such as bonus features, language selection, and captions, and not all
movies available by mail on DVD are available for instant watching. In
addition, some instant watching movies may not be available through all
personal computers or MalayalamIPTV ready devices and the availability of
movies to instantly watch will change from time to time. The quality of the
display of the instant watching movies may vary from computer to computer,
and device to device, and may be affected by a variety of factors, such as
the bandwidth available through and/or speed of your internet connection.
MalayalamIPTV makes no representations about the quality of your instant
watching display.
Availability and Time Limits: The number of movies you may watch instantly
will depend on your plan. To view the details of your specific membership
plan, click the "Membership Terms and Details" link on the "Your Account"
page.

System Requirements and Device Limitations: To enjoy watching instantly via
your personal computer, your equipment must satisfy certain system
requirements. Click here to view the various system requirements. As an
additional member benefit, you may instantly watch on up to six unique
authorized devices, including personal computers and MalayalamIPTV ready
devices. For certain plans, you will be allowed to instantly watch
simultaneously on more than one personal computer or through more than one
device within your household, up to total of four devices at a given time.

that are associated with your plan, click here. The number of devices and
concurrent streams may change without notice to you.
Geographic Limitation: You may not view TV channels or movie through the STB
anywhere other than some restricted countries due to licensing restrictions,
including the U.S. territories, and MalayalamIPTV may use technologies to
verify your compliance.
Account Access; Identity Protection
In order to provide you with ease of access to your account, both through
your computer and MalayalamIPTV Ready Devices, MalayalamIPTV implements
technology that enables us to recognize you as the account holder and
provide you with direct access to your account without requiring you to
retype any password or other user identification when you revisit the R MalayalamIPTV service. You are responsible for updating and maintaining the
truth and accuracy of the information you provide to us relating to your
account.
You are also responsible for maintaining the confidentiality of your account
and password and for restricting access to your computer or NRD. If you
disclose your password to anyone or share your account and/or devices with
other people, you take full responsibility for their actions. Users of
public or shared computers or NRDs, or unprotected MalayalamIPTV Ready
Devices should log out at the completion of each visit. If you sell or
return a computer or MalayalamIPTV Ready Device, you should logout and/or
deactivate the device before doing so. If you fail to log out or deactivate
your device, subsequent users may be able to access your account
information. To deactivate a device, go to Manage MalayalamIPTV ready
devices and computers.
If you find that you're a victim of identity theft and it involves a
MalayalamIPTV account, you should notify customer service. Then, you should
report this instance to all your card issuers, as well as your local law
enforcement agency. MalayalamIPTV reserves the right to place any account on
hold anytime with or without notification to the member in order to protect
itself and its partners from what it believes to be fraudulent activity.
MalayalamIPTV is not obligated to credit or discount a membership for holds
placed on the account by either a representative of MalayalamIPTV or by the
automated processes of MalayalamIPTV.
Disclaimers of Warranties and Limitations on Liability
THE MALAYALAMIPTV.NET SERVICE, INCLUDING TV CHANNELS/VOD FEATURES, AND
FUNCTALITIES ASSOCIATED HEREWITH, THE WEBSITE AND ITS CONTENTS, ARE PROVIDED
"AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND
AND WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE
MALAYALAMIPTV.NET SERVICE, THE WEBSITE AND ITS CONTENTS. MALAYALAMIPTV.NET
DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE
MALAYALAMIPTV.NET SERVICE. INCLUDING SHIPMENT OF STB’s, WILL BE
UNINTERRUPTED OR ERROR-FREE, AND YOU AGREE THAT MALAYALAMIPTV.NET MAY

SERVICE, INCLUDING OUR WATCH INSTANTLY FUNCTIONALITY, OUR COMMUNITY FEATURES
OR ANY OTHER ASPECTS OF THE MALAYALAMIPTV.NET SERVICE AT ANY TIME, WITHOUT
COMPENSATION OR NOTICE TO YOU. MALAYALAMIPTV.NET SPECIFICALLY DISCLAIMS
LIABILITY FOR THE USE OF APPLICATIONS, MALAYALAMIPTV.NET READY DEVICES, AND
MALAYALAMIPTV.NET INSTANT STREAMING DISCS, AS DEFINED IN THE APPLICATIONS
SECTION ABOVE AND ANY DEVICES ASAND SET FORTH IN THE MALAYALAMIPTV.NET READY
DEVICES SECTIONS ABOVE.
Without limiting the foregoing, we assume no liability or responsibility for

MalayalamIPTV service, including damage or defects occurring or caused

protected by United States and international copyright laws or other
intellectual property laws and treaties. The compilation of all content on
this site is the exclusive property of MalayalamIPTV, and protected by U.S.
and international copyright laws. Content shall not be reproduced or used
without express written permission from MalayalamIPTV, or its suppliers. You
agree to adhere to the restrictions set forth under " MalayalamIPTV
streaming ". You agree not to decompile, reverse engineer or disassemble any
software (including but not limited to the MalayalamIPTV Movie Viewer
Software) or other products or processes accessible through the

and not to use any data mining, data gathering or extraction method.
MalayalamIPTV reserves the right to terminate your membership hereunder if
MalayalamIPTV, in its sole and absolute discretion, believes that you are in
violation of this paragraph, such violations including the MalayalamIPTV
instant streaming disc restrictions, copying of DVDs rented to you by us,
the unauthorized use of our instant watching movie feature, the
MalayalamIPTV Movie Viewer Software or the copying or other unauthorized use
of our proprietary content. MalayalamIPTV does not promote, foster or
condone the copying of DVDs or any other infringing activity. The use of the
MalayalamIPTV service, including DVDs rented to you by us and the
MalayalamIPTV instant streaming discs is solely for your personal and
non-commercial use. Please see the instructions at the end of these Terms of
Use for notifying us of the presence of any allegedly infringing content on

any product or service that is not affiliated with MalayalamIPTV, in any
manner that is likely to cause confusion among customers, in any manner that
dilutes the rights of MalayalamIPTV, or in any manner that disparages or

Limitations on Use
You must be 18 years of age or older to become a member of the MalayalamIPTV
service. While individuals under the age of 18 may utilize the service, they
may do so only with the involvement of a parent or legal guardian. While
MalayalamIPTV does distribute products that may be watched by children, we
do not intentionally seek to collect information from individuals 13 years
of age and younger (see also "Profiles"). Unless otherwise specified, our
subscription service and the content on the MalayalamIPTV website, including
content viewed through our STB, are for your personal and non-commercial use
only and we grant you a limited license to access the MalayalamIPTV website
for that purpose. You may not download (other than through page caching
necessary for personal use, or as otherwise expressly permitted by these
Terms of Use), modify, copy, distribute, transmit, display, perform,
reproduce, duplicate, publish, license, create derivative works from, or
offer for sale any information contained on, or obtained from, the
MalayalamIPTV website, including but not limited to information contained
within a member or members' Queue, without our express written consent.
MalayalamIPTV does not promote, foster or condone the copying of digitally
delivered content, or any other infringing activity. You may not frame or
utilize any framing techniques to enclose any trademark, logo, or other
proprietary information (including images, text, page layout, or form) of
MalayalamIPTV without our express written consent.
Right to Terminate
We reserve the right to terminate or restrict your use of our service,
without notice, for any or no reason whatsoever.
Claims of Copyright Infringement
It is the policy of MalayalamIPTV to respect the intellectual property
rights of others. MalayalamIPTV does not promote, foster or condone the
copying of Movies or any other infringing activity. If you believe your work
has been copied in a way that constitutes copyright infringement, are aware
of any infringing material on the MalayalamIPTV.net website, or know of
someone who is making unauthorized use of the content of the
MalayalamIPTV.net website, please notify us at the address specified below
of your concern by submitting a signed written notice and containing the
following:
(i) A physical or electronic signature of a person authorized to act on
behalf of the owner of the copyright interest;
(ii) Identification of the copyrighted work claimed to have been infringed;

Disputes; Governing Law
These Terms of Use shall be governed by and construed in accordance with the
laws of the state of Delaware, without regard to conflicts of laws
provisions. You and MalayalamIPTV.net agree that the United States District
Court in New York/Manhattan or the New Jersey Superior Court for the County
of Middlesex shall have exclusive jurisdiction over any dispute between you
and MalayalamIPTV.net relating in any way to the MalayalamIPTV.net service
or Web site or these Terms of Use. You and MalayalamIPTV.net expressly and
irrevocably consent to personal jurisdiction and venue in these courts. The
parties agree that in any such dispute or subsequent legal action, they will
only assert claims in an individual (non-class, non-representative) basis,
and that they will not seek or agree to serve as a named representative in a
class action or seek relief on behalf of those other than themselves. If any
provision or provisions of these terms shall be held to be invalid, illegal,
unenforceable or in conflict with the law of any jurisdiction, the validity,
legality and enforceability of the remaining provisions shall not in any way
be affected or impaired thereby, and shall remain in full force and effect.
